LeadCall Terms of Use
In short: LeadCall is a tool GenAi Tribe provides to its own client businesses. Use it only on phones your business owns or controls, tell your callers what the law requires, and do not use it to spy on anyone. We work hard to keep it running, but no app can promise to catch every call.
1. About these terms
These terms are between GenAi Tribe (also written GenAi Tribe.Agency), a sole proprietorship owned by Manthri Ashish Raj and based in Hyderabad, Telangana, India (“GenAi Tribe”, “we”, “us”), and the business that uses the LeadCall app (“the business”, “you”). The owner accepts these terms for the business when the business asks us to switch LeadCall on for it, or when the owner sets up or uses LeadCall on a phone. If you do not accept them, do not use LeadCall, and tell us so that we can switch it off. Staff do not accept these terms for the business, but they must follow them, and the owner must make sure they do.
If your business has a signed agreement with us, that agreement comes first where it says something different from these terms. How we handle data is explained in the LeadCall Privacy Policy.
2. Who may use LeadCall
- LeadCall is only for businesses that are clients of GenAi Tribe. It works only after we switch it on for your business. It is not offered to the public.
- It is for business use only. Owners and staff must be 18 or over.
- The owner decides who on the team uses it. Staff join only when the owner adds them or gives them the staff code, or when the business, or GenAi Tribe at the business’s request, connects their phone in GenAi Tribe’s CRM.
- Keep your setup codes to yourself. If a code gets out, tell us and we will change it.
3. Your plan
What the app does for your business depends on the plan agreed between your business and GenAi Tribe. Plans and fees are agreed with us directly, in writing. Nothing is sold inside the app or on this website. If your agreement ends or is paused, we may lock the app or switch features off.
4. What the business is responsible for
- Phones. Install LeadCall only on phones and SIM lines your business owns or controls, and that are used for business calls. Choose the business line carefully in the app. If a phone also has a personal SIM, its calls may be collected; see the Privacy Policy. The only sure way to keep personal calls out is a separate phone for business calls.
- Your staff. Tell staff, before you put LeadCall on a phone they use, what it collects and that the owner can see their calls.
- Your callers. Your callers never see LeadCall, so you must tell them that your business keeps a record of calls and uses it to follow up. For example, add a short line to your recorded greeting, put a notice at the counter, or add a line to your website or Google listing, such as: “We keep a record of calls so we can follow up with you.”
- Recordings. LeadCall does not record calls. If your phone’s dialer records them and you ask LeadCall to copy those recordings, the decision to record is yours, and so is the duty to tell the people you speak to (for example through the dialer’s own announcement) and to follow the law on call recording. Do not switch on recordings if your business deals with health, medical treatment or other sensitive matters (for example a clinic, hospital, pharmacy, diagnostic lab or counselling service), because such calls can contain sensitive personal information; tell us and we will keep recordings off for your business.
- Google Ads. If we send your leads to Google Ads for you (only under a signed agreement), you are responsible for telling your customers as Google’s rules and the law require, for not asking us to do this for a business in a sensitive area, such as health, or one whose callers are mostly under 18, such as tuition or coaching for school students, and for not asking us to send any lead you know to be under 18.
- Your information. Give us correct details about your business, and keep them up to date.
- Keep phones secure. Use a screen lock. If a phone with LeadCall is lost or a staff member leaves, remove that phone or staff member in the app or tell us straight away.
- Obey the law. Use LeadCall and the data in it lawfully, including India’s data-protection law.
5. What you must not do
- Do not use LeadCall to watch or track any person’s private life, including a family member’s or an employee’s personal calls.
- Do not install it on a phone without the knowledge of the person who uses it.
- Do not use the numbers in it to send spam or unwanted marketing, or in any way that breaks telecom rules.
- Do not sell callers’ data, or give it to anyone outside your business except people who help you run it, such as your accountant.
- Do not try to break into, copy, take apart (reverse-engineer), overload or get around the security of the app or our servers, or reach another business’s data.
- Do not use LeadCall for anything illegal.
If we believe LeadCall is being misused, we may suspend it for your business while we look into it.
6. Availability
We work to keep LeadCall running and to fix problems quickly. But it depends on things we do not control: your phone, its maker’s battery settings, Android, your mobile network and the internet. Some phones close apps in the background, and some do not say which SIM a call used. So we cannot promise that every call will be captured or sent, or that the service will never be down. The app shows you how to set up your phone so it works as reliably as possible.
We may improve, change or stop features. If we plan to stop LeadCall altogether, we will tell client businesses in advance and help you take a copy of your call history.
7. Your data
- Your business controls its call history. We use it to provide LeadCall to you, to support you, and to keep the activity log described in the Privacy Policy, and for nothing else.
- On plans that include it, the owner can export calls from the app as a spreadsheet. On any plan, you can ask us for a copy of your call history at contact@genaitribe.agency.
- LeadCall keeps a permanent activity log that cannot be deleted in normal use, in which callers appear by an internal reference number rather than their phone number. A caller’s number, name and notes can be blanked from it. The Privacy Policy explains what it holds and what can be removed.
How we handle your callers’ details for you
For your callers’ details (numbers, names, call times, notes and recordings), we act on your business’s behalf. We will:
- use them only to provide LeadCall to your business and to support it, and to keep the activity log the Privacy Policy describes; and share them only as sections 7 and 8 of the Privacy Policy describe (our service providers, Google Ads only if your business signs an agreement for it, and where the law requires it), or with your business’s own software or people when your business sets that up;
- keep them confidential, and protect them with the security measures in section 11 of the Privacy Policy;
- tell your business without delay if a security breach affects them;
- help your business answer a caller who asks to see, correct or delete their details;
- if a caller asks us to remove their details and your business has not answered us within 30 days, remove them as the Privacy Policy describes;
- delete them when your business asks us to, or after our service to your business ends and you ask us to, except the records the Privacy Policy says we keep and anything the law requires us to keep; and
- use only the service providers named in the Privacy Policy (today, Hostinger for our servers and backups, and Google for Continue with Google and Google Play services).
8. Ending
- You can stop using LeadCall at any time: disconnect or uninstall the app on each phone, and tell us.
- Your agreement with us sets how the service itself ends.
- We may stop providing LeadCall to a business that breaks these terms, or whose agreement with us has ended.
- After it ends, your business’s call records are not deleted automatically. We will ask your business in writing whether it wants a copy and whether it wants them deleted, and delete them when it asks, as section 10 of the Privacy Policy explains. You can also ask us at any time, as our account deletion page explains. The permanent activity log is kept, as the Privacy Policy describes.
9. Limits of our responsibility
- LeadCall is provided as it is. It helps you keep track of calls, but decisions you make with it, such as which callers to call back, are yours.
- We are not responsible for losses caused by your phone, its settings or your mobile network, or by how you or your staff use the app or its data. If a call is missed because of a fault in LeadCall itself, our responsibility is limited as set out below.
- We are not responsible for indirect losses, such as lost profit or lost business.
- Your business will make good any loss we suffer from a claim by a caller, a staff member or an authority, to the extent it is caused by your business breaking section 4 or 5, for example by having recordings copied without telling callers that calls are recorded, or by not telling callers that calls are logged. This does not apply to loss we caused ourselves.
- Where the law allows, our total responsibility to your business for anything to do with LeadCall is limited to the total we charged your business for LeadCall in the three months before the event that led to the claim. If LeadCall is part of a wider plan with no separate charge for it, the limit is the total we charged your business under that plan in those three months. If your business has a signed agreement with us that sets a different limit, that limit applies instead.
- These limits do not apply to loss caused by our fraud or wilful misconduct.
- Nothing in these terms limits responsibility that the law does not allow to be limited, or takes away any right your business has under the Consumer Protection Act, 2019 (if it applies to your business) or under data protection law. They also do not shorten the time the law gives you to bring a claim.
10. Changes to these terms
We may update these terms. We will change the date at the top, and tell client businesses about important changes at least 15 days before they take effect. If you do not accept a change, tell us before then and you may stop using LeadCall without penalty; otherwise, continuing to use LeadCall after that date means you accept the new terms.
11. Law and disputes
These terms are governed by the laws of India. If a disagreement arises, write to us first, and we will both try in good faith to settle it within 30 days. If it is not settled, only the courts at Hyderabad, Telangana will decide it, except where the law gives your business the right to go to a consumer commission or another forum.
